Washington, DC — Today, after the U.S. Supreme Court ruled in 303 Creative v. Elenis that businesses can be granted religious exemptions to anti-discrimination laws that protect LGBTQ+ people, Indivisible’s Director of Democracy Policy Meagan Hatcher-Mays released the following statement:
“At a time when the LGBTQ+ community is under attack at every level, the far-right majority on the Supreme Court just gave homophobes and transphobes a license to discriminate. This case—which should never have been taken up by the Court—was never about websites. Instead, it was an opportunity for the Court’s ultra-conservative justices to assault Americans’ fundamental right to live authentically without fear of discrimination.
“It’s clear that the Court ruled not in favor of ‘religious freedom’ as they claim, but to push a clearly partisan agenda and grant expansive rights to those who would use their religion as a justification to discriminate against others with impunity. This abhorrent ruling will not only allow rampant discrimination, it contributes to the already hostile environment the LGBTQ+ community is navigating, which includes violent threats and sometimes deadly attacks. This Supreme Court doesn’t care at all.
“Today’s decision is yet another example that the Court is fundamentally broken and in desperate need of structural reform to restore balance—and that starts with passing the Judiciary Act of 2023 and expanding the Supreme Court.”
