While we expect the future nominee to be highly qualified, she alone cannot save the Supreme Court from the far-right takeover. The balance of the Supreme Court will still be stacked 6-3 in favor of conservatives. The only way to unrig the courts is to expand it by at least four seats.

We thank Justice Breyer for his nearly 30 years of service on the United States Supreme Court. Over the course of his career, Justice Breyer authored opinions in decisions that upheld women's reproductive rights and criticized the continued use of the death penalty. We are also thankful for his judgement in his decision to step down at a time when President Biden can preserve the current balance of the court, rather than risking a vacancy under a Republican majority, which no doubt would have replaced him with someone at least as ideologically unhinged as Amy Coney Barrett or Brett Kavanaugh.
While Republicans across the country are engaging in some of the most brazen attacks on our democracy and our right to vote, two Democrats – Kyrsten Sinema and Joe Manchin – joined Mitch McConnell in blocking what would have been the most consequential suite of democracy reforms since the passage of the Voting Rights Act of 1965. As a result of Sinema and Manchin’s betrayal, the likelihood of constitutional crises, democratic breakdowns, and rightwing political violence are higher today than it was yesterday. That is their legacy now.
Senator Mark Kelly’s addition to Indivisible’s “Give No Ground” program comes just after he announced his support of a rules change in order to pass voting rights in the Senate, and one day after Indivisible’s flash poll of Arizonans that showed 94% of Indivisibles in Arizona support finding a Democratic primary challenger to Senator Sinema in 2024 if she does not join Senator Kelly in his support of changing the rules to pass voting rights.
Today, Indivisible sent a “flash poll” by text message to Arizona Indivisible activists asking if they’d support a Democratic primary challenger to Senator Sinema in 2024, if she does not support fixing the filibuster and passing voting rights.
